This Decision amends Council Directive 2008/90/EC as regards the extension of the derogation relating to import conditions for fruit plant propagating material and fruit plants intended for fruit production from third countries. Pending a decision by the Commission on whether propagating material and fruit plants produced in a third country are equivalent to propagating material and fruit plants produced in the Union, if same standards are used, a derogation according to which same conditions were deemed applicable was established until 31 December 2018. As from 14 December 2019, the new plant health rules concerning pests and health requirements for propagating material set out in Regulation (EU) 2016/2031 of the European Parliament and of the Council (5) will apply, in order to prevent trade patterns from being disrupted and still allow a sufficient period of time to assess compliance by third countries with the new plant health rules set out in Regulation (EU) 2016/2031 and its implementing legislation, the period of application of the above mentioned derogation is extended until 31 December 2022.
