This legislation applies across the entire federation in accordance with the provisional constitution.Central to the administration of this law is the Somali Agricultural Regulatory and Inspection Services (SARIS), which holds the mandate to oversee and implement the statutory provisions. SARIS is tasked with the regulation of seed-related activities, the appointment of inspectors and seed analysts, and the maintenance of a National Plant Variety List intended for public access via the Official Bulletin. The law further mandates the establishment of official seed testing centers to facilitate research and quality control.Enforcement mechanisms are primarily vested in authorized inspectors who possess broad powers to enter and examine buildings, vehicles, or vessels where seeds are stored or processed. These inspectors are authorized to seize seeds or plant materials if there are reasonable grounds to believe a violation of the law has occurred. To ensure professional accountability, inspectors must take an official oath upon appointment and are prohibited from engaging in any commercial seed-related activities, such as import, export, or sale.The legal framework also details judicial remedies and penalties for non-compliance. Courts are empowered to order the destruction or disposal of illicit seeds and may require convicted individuals to bear the costs associated with laboratory analysis. Furthermore, the law imposes strict confidentiality requirements on officials, prohibiting the unauthorized disclosure of sensitive data obtained during the execution of their duties, with violations prosecuted under the Somali Penal Code. Obstruction of an inspector or the refusal to provide necessary documentation is explicitly classified as a criminal offense.
