Abstract:

Under the Court’s Judgment on merits, Costa Rica entitled to compensation for material damage caused on its territory by Nicaragua’s unlawful activities.

Present Judgment determining the amount of compensation.

Claim for compensation for environmental damage. Such a claim not previously adjudicated by the Court. Damage to environment compensable under international law. Compensation may include indemnification for impairment or loss of environmental goods and services and payment for restoration. Methodology for valuation. Ecosystem services approach advanced by Costa Rica. Replacement cost approach advanced by Nicaragua. Neither approach followed exclusively by the Court. No specific method of valuation for purposes of compensation for environmental damage prescribed by international law.

The Court to be guided by principles and rules applicable to compensation.
