Abstract:

The Constitutional Court is asked to review the constitutionality of the African Biotechnology Agency’s Statutes.

The Agency’s statutes provide that the Agency aims to increase the development of biotechnology for economic and social development, to reinforce the members states' capacities in the areas of research-development and in the production of biotechnologies, and to promote the application of biotechnology in accordance with the objectives of sustainable development and the preservation of environment.
The Agency has also the objective to coordinate and promote programs of research. Thus, the Agency’s Statutes comply with the Constitution, more specifically with its Preamble and its Title I. Consequently, the dispositions of the Agency’s Statutes comply with the Constitution.
