This Decree completely prohibits the fishing for spring-spawning herring in the territorial and inner waters of Svalbard in 2009. It applies to Norwegian and foreign commercial fishing vessels of any type and support vessels including vessels for experimental fishing and exploration. Infringement, caused by either intentional or negligent behaviour, shall be punished in accordance with section 4 of the Act relative to Svalbard of 1925 and sections 61 and 64 of the Marine Living Resources Act. Assistance in fishing or attempt to fish shall be regarded as fishing and shall be punishable on the same terms.
