This Act regulates the planning, construction, reconstruction, use, and removal of buildings and other structures in the Republic of Slovenia. It establishes the legal framework governing construction activities and defines the conditions under which buildings may be designed, built, modified, and used. It sets out the procedures for obtaining building permits and use permits, as well as the documentation and approvals required before construction can begin.
The Act defines the roles and responsibilities of participants involved in the construction process, including investors, designers, contractors, supervisors, and competent authorities. It specifies requirements for project documentation, supervision of construction works, verification that construction complies with approved plans and applicable regulations and the procedures for notifying authorities about certain types of construction works.
Is is stated that construction activities must comply with environmental protection rules and other applicable regulations concerning the protection of natural resources and the environment. During the permitting process, competent authorities verify whether the proposed construction is consistent with environmental requirements and with restrictions that may apply to specific areas, such as protected natural zones or areas subject to special environmental conditions. Where required, construction projects must obtain opinions or approvals from the relevant authorities responsible for environmental protection and related sectors.
In addition, the Act establishes rules for the completion and use of buildings, including the conditions under which a building may be put into operation after construction is finished. It contains provisions concerning temporary structures, changes to existing buildings, demolition of structures, and the maintenance of built facilities and addresses situations involving buildings constructed without the required permits and sets out procedures related to their legal status and possible regularization. The Act further provides for administrative supervision of construction activities and outlines the powers of inspection authorities responsible for monitoring compliance. It includes provisions on enforcement measures and administrative procedures in cases where construction activities do not comply with the applicable requirements.
