الدولة التي لم تصدق على اتفاق دولي أو تنضم إليه وإلا أصبحت طرفاً فيه. وبوصف هذه الدولة غير طرف فإنها قد تتمتع بحقوق محدودة في المشاركة في المفاوضات أو المداولات في إطار الاتفاق، أو في الاحتجاج بأحكام الاتفاق.
