This Regulation implements the Nature Conservation Act 1992. It consists of nine Chapters divided into 153 sections. The Regulation is completed by nine Schedules that specify the contents of the Regulation.
Chapter 2 sets out general provisions about protected areas. Chapter 3 considers the application for a permit to take, use, keep or interfere with cultural or natural resources (a resources permit), an apiary permit, an Aboriginal tradition authority or an Island custom authority. In considering the applications, the chief executive must have regard to each of the following: (a) the impact the activities that may be conducted under the permit or authority may have on the character and amenity of the protected area to which the permit or authority applies and adjacent areas; (b) the likely cumulative effect of the proposed use and other uses on the protected area to which the permit or authority applies. The same criteria applies in considering the application for permits concerning access to, use of and conduct within protected areas (Chapter 4). The remaining Chapters provide for: regulatory notices and declarations in protected areas; offences about access to, using and conduct in protected areas; authorized activities in protected areas; and seizure of things in protected areas.
