في سياق البيئة فإن ’للدول، بموجب ميثاق الأمم المتحدة ومبادئ القانون الدولي، الحق السيادي في استغلال مواردها الخاصة بها بمقتضى سياساتها البيئية والإنمائية، وعليها مسؤولية كفالة ألا تسبب الأنشطة التي تقع داخل ولايتها أو تحت سيطرتها ضرراً لبيئة دول أو مناطق أخرى تقع خارج حدود ولايتها الوطنية‘.
