This Act provides for: promoting a globally competitive coffee industry; regulating the coffee sector; creating a framework for the registration and licensing of various players within the coffee sector; delineating the roles of the National and County Governments in the regulation, development and promotion of the coffee sector; promoting the vertical integration of the value chain actors for purposes of achieving economies of scale; promoting evidence based coffee research and training for the development of the coffee sector; strengthening the establishment and management of coffee development levy; and enforcing a mechanism for dispute resolution within the coffee sector. The Act concerns: establishment of the Coffee Board, appointment of its members and definition of its powers; specification of its functions, including: regulating and promoting the development of the coffee industry; ensuring registration of coffee dealers; collecting and maintaining a data base and ensuring ease of access to information on the coffee industry; conducting national and international coffee market intelligence and surveys to facilitate market access and inform promotional and branding strategies; establishing linkages with various government agencies; developing and implementing a framework for the capacity building of players in the coffee industry; developing and enforcing the coffee industry standards and industry code of practice in collaboration with the Kenya Bureau of Standards; regulating the marketing and trading of coffee. Further matters covered by this Act include: role of county governments, including implementing the National Government policy relating to coffee; licensing of coffee operations; regulation of production and processing of coffee, including providing incentives to farmers and post-harvest services; establishment of the coffee research and training institute and specification of its powers; functions of the institute; financial provisions of the institute; undertaking soil mapping and analysis to determine nutritional requirements for coffee production; importation of coffee planting materials; certification of Kenyan coffee; requirements relating to coffee traceability and disclosures; coffee trading and marketing measures; quality assurance for coffee industry; inspections; compliance with international coffee standards; dispute resolution committee; penalties.
