This Act, comprising 5 sections, amends the original Act as follows (i) Section 2, introducing a new definition of “legally disqualified” and linking it to the absence of legal capacity under the Mental Health Act; (ii) replacing Section 4, to restructure the composition of the Board. The new Board includes a Chairperson with expertise in coffee and agriculture, representatives from key ministries (agriculture, commerce, finance), the Attorney-General, representatives of both small- and large-scale coffee growers, a coffee research institution, coffee roasting license holders, and two private sector members. It also introduces eligibility rules excluding undischarged bankrupts, legally disqualified persons, and individuals convicted of serious offences; (iii) repealing and replacing Section 5 to regulate tenure and vacancies of Board members. Members serve a four-year term, renewable once. It also sets detailed conditions for vacating office.
