The Regulations establish measures to ensure sustainable fishing and compliance with regional fisheries arrangements by setting clear objectives, definitions, and operational rules. They require fishing permits to be valid only if specific conditions are met, mandate catch retention, prohibit the use of fish aggregating devices and fishing in certain high-seas areas, and require the use of observers and mobile transceiver units for monitoring and control. The Regulations also create offences with penalties for non-compliance and include schedules on discard reporting and the implementation of the Nauru Agreement’s additional access terms for fisheries zones. They implement Tuvalu’s obligations under the Marine Resources Act 2006 and the Nauru Agreement, regulating fishing activities in Tuvalu’s exclusive economic zone (EEZ) and high seas areas where Tuvalu has rights.
