This Act, implementing European Directives on electricity market rules, provides a framework for ensuring reliable, sustainable, efficient, and environmentally sound operation of electricity and gas supply through rules on production, transport, and delivery. The Act aims at: promoting renewable energy integration through active consumers, energy communities and guarantees of origin, enhancing market competition, unbundling network operators from production and supply, guaranteeing access to systems, and supporting energy transition while addressing energy poverty and security. The Act defines the following relevant terms: biomass; gas congestion; congestion management; energy sharing; electricity distribution system operator; associated equipment for the transport of electricity; energy trading market; energy from renewable sources; natural gas; high-efficiency combined heat and power installation; supply agreement for the supply of electricity or gas to an end customer; micro-enterprise. Chapter 1 of the Act concerns energy poverty definition and criteria for market participants. Chapter 2 concerns energy markets and focuses on the following matters: rights and obligations regarding delivery and aggregate; licenses for small connection; guarantees of origin for renewables; transparent contracts and fair prices; general prohibitions for market participants; measures for protecting vulnerable, micro and small consumers with model contracts; creation of energy communities for renewable energy sources exploitation; control system for measuring devices.
Chapter 3 concerns system management of electricity and gas and focuses on the following matters: designation, certification and recognition of system administrators; appointment of administrator; prohibition of privatisation of the transmission and distribution system; execution and subcontracting of activities; general provision on transmission and distribution system operators in relation to European Law; electricity storage facility; investment plan; collection of measurement data of a gas transmission system operator; quality assurance and emergency plan; damage compensation scheme for offshore electricity transmission system; tariffs. Chapter 4 concerns managing and exchange of data; register of transmission or distribution system operators; reporting incidents; use and provision of data by transmission or distribution system operator; tasks of data exchange entity. Chapter 5 focuses on compliance, inspection and supervision; market surveillance; dispute resolution between party and system operator by the Authority. Chapter 6 concerns miscellaneous measures: adoption of National Energy System Plan; establishment and tasks of Energy Council, including: ensuring transition to a climate-neutral, robust, affordable and reliable energy system; promoting the strategic independence of the supply of sources of energy. Chapter 7 provides for final provisions.
