This Act provides for regulation of fertilizers, including chemical, organic and bio-fertilizers, in Bangladesh. Section 4 constitutes the National Fertilizer Standardization Committee for giving advise to the government on matters related to fertilizers, to conduct tests, make recommendations for approval of specification for organic fertilizers, and other functions as mentioned. Section 8 states that no person shall produce, import, preserve, distribute, market, transport or sell any kind of fertilizer without obtaining registration from the Registration Authority. Section 9 provides for appointment of Inspectors for implementation of provisions of the Act. The duties and functions of Inspectors are laid down. The Act further regulates production (Sec. 10), import (Sec. 11) and storage, sale, marketing, transportation and distribution (Sec. 12) of fertilizers.
Section 13 provides for the labelling and packaging requirements for fertilizers. Section 14 lays down the procedure to be followed by the Inspector if any person produces, preserves, sells or distributes any fertilizer or its raw materials beyond specification or is environment polluting. Such fertilizer must be destroyed in manner prescribed. Section 15 provides for penalty for selling of plant nutrient deficient fertilizer. The Act further prohibits sale of misbranded or adulterated fertilizers and punishment for the same is laid down. Section 18 states the limit for harmful substances that can be used in fertilizers. The Act makes provisions in respect of trials, place and procedure for trials, and appeals.
