This Act makes amendments in the Fisheries Act Cap. 108 (the principal Act). The interpretation section in Section 2 of the principal Act is amended by adding marine mammals to the definition of fish and by inserting new definitions of observer and marine mammals. New Section 28A is inserted in the principal Act, as regards the establishment, planning and management of an observer and monitoring programme for collecting and reporting information for scientific, management and compliance purposes under the principal Act, as well as the requirements to become an observer. This Act amends Section 40 of the principal Act by giving the power to the Minister to make regulations for the protection and conservation of marine mammals, and by inserting new subsection 4 regarding penalties (fine or imprisonment) that may be attached to regulations made under Section 40.
