This Government Decision approves two annexes: (i) the Methodology for calculating the cost of the environmental contract, and (ii) the Nomenclature of services related to the issuance of the environmental contract and the amount of the tariffs for those services. The text aims to establish a uniform, cost based system for determining the tariffs charged by the Environment Agency for services connected with issuing environmental contracts, ensuring that operational costs are covered and that the tariff structure is transparent and methodologically grounded. The Methodology defines key concepts such as direct costs, indirect costs, operational activity costs, stages of issuing the environmental contract, related services, and tariff. It specifies that the tariff calculation mechanism is based on covering the operational costs of the services provided and that tariffs are determined on the basis of a detailed analysis of the actual expenses incurred by the Environment Agency in the previous period. The structure of costs included in the cost of the environmental contract is broken down into direct costs (personnel costs, social contributions, and material costs directly linked to the service), indirect costs (overheads such as rent, security, utilities, communications, depreciation, transport, staff training, equipment servicing, and other costs), and operational activity costs (personnel and social costs of management and support services). The Methodology sets out formulas for calculating each cost component and for allocating indirect and operational costs using a cost factor based on hours worked. The Decision further provides that the cost of issuing the environmental contract is estimated separately for each stage of the process, and that tariffs for the related services, calculated according to the Methodology, are listed in Annex No. 2. The Nomenclature sets fixed tariffs in national currency for specific services: preliminary assessment of the planned activity with issuance of a decision/environmental contract; environmental impact assessment at national level with issuance of a decision/environmental contract; environmental impact assessment at national level including transboundary procedures; review of the environmental contract; and a free of charge service for biodiversity assessment with issuance of the relevant decision/conclusion. The Environment Agency must apply these tariffs when issuing environmental contracts, and the Ministry of Environment is tasked with overseeing implementation. Tariffs are to be updated when the service methodology changes or when there is at least a 5% change in the cost elements underlying their calculation.
