The state creates conditions for the implementation of housing rights through the construction of housing, the promotion of the development of the housing market, the provision of housing to citizens in the established manner, under a social rental agreement or rental agreements for residential premises of the state or municipal housing stock, the protection of the legal rights and interests of owners, other users of housing and consumers of utilities, and monitoring the implementation of legislation on housing construction. The housing legislation of the Republic of Tajikistan regulates, inter alia, the following relations: (a) operation and maintenance of residential premises; (b) provision of public utilities; and (c) payment for housing and utilities. The use of residential premises is carried out in compliance with the rights and legitimate interests of citizens, sanitary and hygienic, environmental, architectural and urban planning, fire safety and other requirements stipulated by the national legislation. Standard rules for the use of residential premises are approved by the authorized state body in the housing sector. An agreement for hot and cold water supply, water disposal, electricity supply, gas supply (including delivery of domestic gas through pipes), heating (provision of heat, including delivery of solid fuel for stove heating), and removal of domestic waste is concluded with each owner of the housing who has the right to directly manage the apartment building on his behalf. The fee for utilities includes the fee for cold and hot water supply, sewerage, electricity, gas, heating, collection and removal of household waste. This Law primarily focuses on the housing legislation, establishing a legal framework for housing relations based on the Constitution and relevant laws.
