This Law regulates the manner of organizing and performing energy activities in the natural gas sector, the competences of the Energy Regulatory Commission of the Republic of Srpska in the natural gas sector, the conditions for the orderly, high-quality and safe supply of natural gas to customers, access to the natural gas market, as well as the rights and obligations of market participants, customer protection, and supervision of the implementation of this law and other issues of importance for regulating the natural gas sector.
The purpose of this Law is to: 1) establish the criteria and procedures applied for granting authorizations for performing activities in the natural gas sector, provide legal frameworks for companies to provide public services for the uninterrupted supply of natural gas to consumers and supervise the performance of these activities; 2) establish a legal framework for unlimited trade and uninterrupted supply of natural gas according to defined quality standards for the benefit of customers; 3) ensure safe, reliable and efficient operation of the natural gas transport system and the provision of natural gas transport and management services to all system users, as well as other systems, facilities and activities in the natural gas sector; 4) determine the rights and obligations of energy entities performing activities in the natural gas sector in the manner and under the conditions set out in this Law and determine in more detail the rights and obligations of the Regulatory Commission, as well as the legal basis for mutual relations between energy entities performing activities in the natural gas sector and their relations with the Energy Regulatory Commission of the Republika Srpska; 5) creates conditions for the further development of an open natural gas market based on the principles of competition, non-discrimination, publicity and transparency; 6) establish the Rules for the organization and functioning of the natural gas market, including its further development and integration into the pan-European market; 7) ensure the effective unbundling of the transmission system operator and its independence from other activities related to natural gas and from other commercial interests; 8) create conditions for appropriate investments in the natural gas sector; 9) establish the legal basis for regional and international cooperation between transmission system operators and other energy entities in the gas market of the Republic of Srpska, as well as for mutual cooperation between competent authorities, the Regulatory Commission, institutions and other public bodies. The provisions of this Law shall apply to biogas and gas from biomass or other types of gases if these gases can be technically and safely transported through natural gas systems.
