The Kuwaiti Penal Code is organized into 282 articles divided across three books that establish the country's criminal law framework. Book One (Articles 1–91) sets out the general principles of criminal law, including the principle of legality, which provides that no act may be considered a crime and no punishment imposed unless established by law. It classifies offenses into felonies and misdemeanors, defines the territorial application of the law, establishes rules on criminal responsibility, and identifies circumstances that exclude liability, such as insanity, coercion, necessity, or lawful conduct. This section also includes mechanisms for sentence mitigation, probation, and parole. Book Two (Articles 92–148) addresses crimes against the public interest, with the objective of protecting state security, public administration, and the justice system. It criminalizes offenses such as treason, attacks against the state or its institutions, incitement to overthrow the government, military mutiny, unlawful assemblies, and acts that disrespect religious institutions or sacred places. The book also establishes offenses involving public officials, including bribery, abuse of authority, unlawful detention practices, torture, illegal entry into homes, and extortion. In addition, it safeguards the integrity of judicial proceedings. Book Three (Articles 149–282) regulates crimes committed against individuals and private property. It covers offenses against life and physical integrity, including homicide, manslaughter, negligent killing, assault causing injury or disability, kidnapping, unlawful detention, abortion-related offenses, and other crimes affecting personal liberty. It also addresses crimes against morality, honor, and reputation, such as sexual offenses, adultery, public indecency, prostitution-related offenses, gambling, drug trafficking, public intoxication, defamation, and insult. The final part focuses on property crimes, including property damage, counterfeiting, forgery, and other acts that threaten ownership rights and economic security.
