This Framework Law regulates legal relations concerning immovable property with the status of housing in the Republic of Moldova, regardless of ownership type or specific destination. It defines the right to housing as a fundamental component of the right to a decent life, detailing elements such as stability of tenancy relations, access to adequate services and infrastructure, non-discrimination, and transparency of public authorities. The Law establishes the legal basis and sets objectives including regulation of housing relations, guaranteeing freedom to exercise housing-related rights and interests, and ensuring fulfilment of obligations arising from law, co-owners’ statutes and contracts. It provides a comprehensive glossary of key concepts (public housing stock, social housing, service housing, maneuver housing, hostels, protocol housing, block of flats, common property, communal and non-communal services, reconstruction, rehabilitation, administrator, and minimum housing standards). It also affirms state obligations to ensure access to various categories of public housing within available stock. The Law regulates the emergence, exercise, modification and extinction of possession, use and disposal rights over public housing, the use of private and public housing under lease or other legal grounds, change of use, reconstruction, administration, integrity, maintenance and repair of housing, payment for use and services, and control by central and local authorities. It strictly conditions change of destination of public housing and sets procedures for technical-sanitary assessment and demolition or re-use. It allocates detailed competences to the Government (national housing policy, unified registration and evaluation system, minimum standards, criteria for social housing, reconstruction rules, domicile registration mechanisms) and to local authorities of the first level (implementation of housing policy, keeping registers of persons entitled to social housing, construction and acquisition of social, maneuver and service housing, decisions on reconstruction/demolition, administration of public housing stock, control of use and integrity, and information of the population). Substantive chapters regulate social housing (eligibility criteria based on income, lack of property and prior benefits, priority categories, registration, removal from registers, allocation norms, installation, reconstruction, rent and service payments, and eviction rules), service housing, maneuver housing, hostels, and protocol housing for high officials. A central chapter governs use of housing under lease contracts, including form, registration, mandatory clauses, rights and obligations of lessor and lessee, rent calculation and adjustment, payment modalities, sublease conditions, temporary absence, maintenance and repair, reconstruction with temporary rehousing, modification and termination of contracts, and grounds and procedures for eviction. Further provisions address administration of housing and common property through administrators or condominium associations, cost-sharing rules, tariffs for technical services and repairs, and detailed rules on contracting and paying for communal and non-communal services, including metering, allocation of unmetered consumption, and limits on disconnection. The Law also regulates access to dwellings for inspections and emergency interventions, reconstruction of premises in blocks of flats (decision-making, permits, prohibitions, controls and consequences of unauthorized works), and establishes civil, administrative or criminal liability and compensation for damage.
