This Order regulates the production and marketing within the EU of fruit plants and fruit plant propagating material, while excluding material intended for export to third countries if it is clearly identified and kept separate. It also permits imports from outside the EU where the plants or propagating material are recognised as equivalent to EU-produced material. The Order defines key concepts such as suppliers, marketing, propagating material, fruit plants, varieties, clones, mother plants, certified material and CAC material, and requires suppliers of fruit plants or fruit plant propagating material to be registered with the Danish Agricultural Agency, subject to exceptions for suppliers selling only to non-professional final consumers. It also sets rules on supplier approval for different production categories, including candidate pre-basic mother plants, pre-basic plants, basic material and certified plants.
The Order provides that propagating material and fruit plants may only be marketed if they are officially certified as pre-basic plants, basic material or certified material, or qualify as CAC material, and lays down additional requirements for genetically modified varieties, protected or registered varieties, supplier obligations, labelling, packaging and closure. It establishes detailed certification requirements for pre-basic plants, basic material, certified material and CAC material, including varietal identity, health requirements, soil and production conditions, removal or correction of non-compliant plants, inspections, testing and traceability. The annexes list covered genera and species, including chestnut, citrus, hazel, quince, fig, strawberry, walnut, apple, olive, pistachio, Prunus species, pear, Ribes, Rubus and Vaccinium, and contain detailed rules on labelling, supplier records, official inspections, production requirements and regulated non-quarantine pests. The Order provides for control by the Danish Agricultural Agency, fines and administrative fine notices, and implements several EU directives on fruit plant propagating material and fruit plants intended for fruit production.
