This Act, consisting of 53 artcles, aims to establish the South African Pharmacy Council with the main tasks of (i) protecting public health by promoting high-quality pharmacy services; (ii) advising the Minister on pharmacy matters; (iii) ensuring pharmaceutical care that meets universal standards; (iv) safeguarding the public’s right to acceptable pharmacy practice; (v) setting and enforcing standards for pharmacy education, training, registration, professional practice, conduct, and oversight; (vi) operating transparently; (vii) upholding the dignity and integrity of the pharmacy profession. The Council’s main powers are to manage registrations and examinations, regulate and inspect pharmacy practice, form committees and oversee its own procedures, appoint and delegate staff, handle its finances and property, conduct legal and administrative actions, and set or collect fees for its services. Part II establishes that only individuals registered in the prescribed pharmacist categories may perform pharmacy-related services or claim specialist status. It sets out the Council’s authority to prescribe categories, requirements, conditions, and procedures for registration, removal, and restoration; maintain and certify registers; refuse or cancel registrations; and require information from authorised persons. The register’s main tasks are to record, maintain, update, verify, remove, restore, and certify registration information for pharmacists and pharmacy premises under the Act. Any unregistered person who practices as a pharmacist commits an offence and, upon conviction, is liable to a fine (Article 29).
