This Act, consisting of 75 articles and divided into eleven Parts, provides for general requirements related to public procurement, for the establishment of procurement authorities, for the award and the administration of contracts. The Act applies to every department of the Government and statutory bodies, and defines the following objectives and purposes: simplifying and modernising public procurement; promoting transparency and encouraging competition; ensuring fair and equitable treatment of all the persons involved in public procurement; increasing sustainable development and economic efficiency of the country through public procurement activities. Part 2 concerns administration of the procurement system and includes: responsibilities and powers of the Minister; establishment of the central procurement Board and definition of its power and responsibilities; establishment of the central procurement Office and definition of its functions; establishment of other officers and committees. Part 3 concerns confidentiality and exemptions of procurement in certain cases.
Part 4 provides for general procurement requirements and procurement planning and specifically: execution of agreements; determination of need for procurement; time limit for processing of procurement; registration and participation of bidders; submission of a bid and related procedures. Further Parts concern procurement procedures, processes and award of contract; methods of procurement; contract administration and related duties; transparency; ethical standards and procurement integrity; financial interests; public procurement functions; public-private partnership; civil liability and offences; general penalties and specific penalties in case of corruption; power to issue Regulations.
