This Regulation prescribes the methods for testing the distinctness, uniformity and stability of a new plant variety (DUS testing) and the manner of submitting the information, documents and materials required for DUS testing. DUS testing includes testing of a plant variety in the experimental field and in the laboratory for the purpose of entry in the variety registers. DUS testing determines the properties of a new plant variety for determining distinctness, uniformity and stability, without taking into account the properties for production and use value, whereby the material for DUS testing is delivered to the test performer untreated.
With regard to distinctness, uniformity and stability, the new plant variety from Annex 1 of this text must: 1) meet the requirements from the protocol for testing distinctness, uniformity and stability of the European Union Plant Variety Protection Office - CPVO, from Annex 2 Part A; 2) to comply with the guidelines for DUS testing of the International Union for the Protection of New Varieties of Plants – UPOV, from Annex 2 Part C. New varieties that can be used for organic production from Annex 2 Part A should meet the requirements of Annex 2 Part B in terms of uniformity.
