The following general principles of the Revised Protocol on Shared Watercourses in the Southern African Development Community (SADC) Region shall apply the following principles: a) sustainable development; b) precautionary; c) intergenerational equity; and d) assessing transboundary impacts. The purpose of this Agreement is to establish the Commission for the Watercourses of the Incomati and Maputo River Basins and to promote cooperation between the Parties to ensure the development, protection and sustainable use of water resources.
To fulfill the purpose of this Agreement, the Parties shall: a) ensure that the use of the watercourses of the Incomati and Maputo river basins is free for each Party within its territory and without prejudice to its sovereign rights; b) ensure respect for and application of existing international law or customary rules relating to the use and management of water resources; and respect and fulfill the interests of the communities in the equitable use of the watercourses of these river basins; c) maintain an appropriate balance between developing resources for a higher standard of living for its people and conserving and improving the environment to promote sustainable development; d) establish and cooperate in the study and execution of all projects that affect the watercourses of these water basins; e) exchange information and data available on the hydrological, hydrogeological, quality of water resources, meteorological and ecological conditions of the Water Courses of the Watersheds of these rivers; f) use and develop the watercourses of these water basin rivers in an equitable manner, in order to obtain optimal use and benefits compatible with adequate protection; g) take appropriate measures to prevent significant damage from occurring in the Watercourses of these river basins, in their respective territories and in other countries;
