This Resolution approves the procedure for conducting auctions and competitions for leasing surface waterbodies for fishfarming. The regulation establishes the legal framework governing how ponds and flooded quarries may be leased for aquaculture purposes. It defines the responsible authorities, including district and regional executive committees, which organize and oversee the bidding process through specially appointed commissions.
The Regulation sets out detailed rules for organizing and conducting tenders. Both legal entities and individuals, including individual entrepreneurs, may participate. The commission is responsible for publishing notices, determining the starting lease price, receiving applications, evaluating bids, and documenting the results. Public notices must include information about the waterbody, leasing conditions, deposit requirements, application procedures, and the date and format of the auction or competition. Participants are required to submit an application and a security deposit equal to 20 percent of the initial lease price or annual rent.
The document also describes the procedures for selecting winners and finalizing lease agreements. Auctions are conducted through competitive bidding with predefined price increments, while competitions assess participants’ written proposals against established conditions. A minimum of two participants is generally required, although special rules allow a lease to be awarded when only one qualified applicant participates. The Regulation governs the preparation of protocols, confidentiality of participant information, return of deposits to unsuccessful bidders, reimbursement of tender organization costs by the winner, and the resolution of disputes arising from the tender process.
