The purpose of this law is to sustainably safeguard and restore the functions of the soil in implementation and supplementation of the Federal Soil Protection Act. The law emphasizes the importance of sustainable soil management and establishes a legal framework for addressing soil contamination and protecting soil quality. Key legal principles include the obligation of various stakeholders to report harmful soil changes and the establishment of competent authorities to oversee compliance with the law. The law requires individuals and entities responsible for harmful soil changes or contaminated sites to promptly notify the relevant local authorities if there are concrete indications of such issues, including instances where investigations reveal threshold values have been exceeded. It also defines the responsibilities of authorities in reviewing these reports and carrying out necessary assessments. Additionally, the law establishes requirements for experts and testing facilities involved in soil protection, mandating recognized qualifications and appropriate technical equipment, as regulated by the responsible ministry through legal ordinances. The law allows for the delegation of responsibilities to other authorities and emphasizes the need for cooperation between different jurisdictions. It also includes provisions for the collection and dissemination of information regarding enforcement activities.
