Abstract:

The defendant, BGP Properties Pty Limited, cleared an area of land on which a protected species of plant listed in the Threatened Species Conservation Act 1995 was located. In doing so, he destroyed thousands of plants of the so-called Tetratheca juncea and therefore was charged with picking a threatened species under s 118A(2) of the National Parks and Wildlife Act 1974. The defendant pleaded guilty and was convicted and fined the sum of $40,000.
