These Regulations amend the Packaging (Essential Requirements) Regulations 2003 so as to implement Article 1(1) and the Annex of Directive 2004/12/EC of the European Parliament and the Council amending Directive 94/62/EC. They provide for an amendment to the definition of "packaging" to include additional criteria for determining whether an item is packaging and provide illustrative examples of the application of these criteria.
