This Act provides for the establishment of the Coffee Board of Kenya as a body corporate and the Coffee Development Fund, and provides for control of the processing and marketing of coffee in Kenya and the international trade in Kenyan coffee. The Board shall promote competition in the coffee industry, production, processing and branding of Kenya coffee locally and internationally, and generally regulate the coffee industry in the public interest. No person shall: (a) buy, sell, mill, warehouse, export or otherwise deal in or transact any business in coffee unless (s)he is a holder of a licence issued by the Board; (b) transport or have in his or her possession any coffee unless (s)he is licensed to do any of the things specified in paragraph (a) and is the holder of a movement permit issued by the Board. The Act defines and provides with respect to: a coffee dealers licence; a coffee miller’s licence; a marketing agent’s licence; a warehouseman’s licence; and a pulping station licence. The Act also provides for registration of various actors of the coffee industry and provides that every smallholder grower must register with the cooperative society to which (s)he delivers coffee, and that a coffee plantation grower must register with the Board.
