根据第1条，公平合理分享由利用遗传资源而产生的惠益；实现手段包括遗传资源的适当取得及有关技术的适当转让，但需顾及对这些资源和技术的一切权利，以及提供适当资金，包括（第八条j款）公平分享利用土著和地方社区体现传统生活方式而与生物多样性的保护和持久使用相关的知识、创新和做法而获得的惠益。（来源：《生物多样性公约》第一条、第八条 j款）
