The present Act establishes a legal framework for the issuance, transfer, and cancellation of electronic certificates that verify the origin of electricity, gas, heating, or cooling. It defines guarantees of origin as electronic documents issued per unit of energy (1 MWh) and administered by a designated supervisory authority, which maintains a central electronic register and ensures compliance through oversight powers, including inspections and enforcement measures. Guarantees may only be issued for energy that has been properly measured and reported, and only one certificate may be issued per energy unit; they can also be transferred between holders and must be cancelled when used to prove origin.
The Act also regulates the recognition of guarantees from other EU Member States and certain third countries, establishes procedures for correcting registry errors, and provides for liability where technical faults cause damage. It grants the government and relevant authorities the power to issue detailed regulations on measurement, reporting, content of guarantees, fees, and account management. Decisions can generally be appealed to administrative courts, and the Act includes transitional provisions replacing earlier legislation while ensuring continuity for previously issued guarantees.
